1. INTRODUCTION

Welcome to SabaiFresh™, a brand operated by Tindahan Global Distribution Co., Ltd., based in Hong Kong with active operations in Thailand and the Philippines.

By accessing or using our website (www.sabaifresh.com) and related platforms (including social media pages, partner sites, and marketplaces), you agree to be bound by these Terms & Conditions (“Terms”).

  • “Company”, “we”, “us”, “our” – SabaiFresh™ / Tindahan Global Distribution Co., Ltd.
  • “Customer”, “you”, “your” – any person or entity purchasing or accessing our website or products.
  • “Products” – goods (fresh produce, non-perishables, packaging items, etc.) offered for sale.
  • “Services” – all related e-commerce, logistics, promotions, and marketing activities.

4. ELIGIBILITY

You must be at least 18 years old or have parental consent to make a purchase.
By using our website, you represent that you have the legal capacity to enter into binding agreements under applicable law.

5. ACCOUNT REGISTRATION

You may browse without an account, but to order or access certain services you must register an account.

We strive for accuracy but do not warrant that product descriptions, pricing, or photos are error-free.
Minor differences in color, weight, shape, or appearance are natural for fresh produce and not considered defects.

If an error is discovered (e.g., pricing or typographical error), we reserve the right to correct it, cancel the order, or adjust pricing before confirmation.

7. ORDER ACCEPTANCE & CONFIRMATION

Your order constitutes an offer to purchase.
We reserve the right to accept or reject any order at our discretion for reasons including:

  • Stock unavailability
  • Suspicious or fraudulent transactions
  • Delivery area restrictions
  • Payment authorization failure

A binding contract is formed only upon issuance of an order confirmation or delivery notice.

8. PRICES, PAYMENTS & TAXES

All prices are listed in Hong Kong Dollars (HKD) unless otherwise stated.
Prices may change without notice but confirmed orders remain honored at the agreed rate.

We accept secure payments via credit/debit cards, online payment gateways, and approved e-wallets (e.g., GCash, Alipay, PayPal, etc.).
All payments must be authorized and cleared before dispatch.

Prices exclude customs duties, import taxes, or local levies applicable in your country/region. You are responsible for any such fees imposed by authorities.

9. SHIPPING, DELIVERY & RISK

We deliver through trusted logistics partners such as SF Express, Lalamove, Hongkong Post, or other approved couriers.

  • Delivery times are estimates; unforeseen events (weather, customs, delays) may extend timelines.
  • Risk of loss or damage passes to you upon delivery to the specified address or upon first delivery attempt if the receiver is unavailable.
  • Once delivery is confirmed, we bear no responsibility for spoilage, theft, or mishandling thereafter.
  • Customers must provide accurate address, contact details, and delivery instructions.

10. RETURNS, REFUNDS & REPLACEMENTS

Our detailed Returns & Refunds Policy forms part of these Terms.
Key points:

  • Perishables: Quality-on-arrival only; report within 12 hours of receipt with photo proof.
  • Non-perishables: 7-day return if unopened & unused; RMA required.
  • Shipping fees are non-refundable unless the fault lies with us.
  • Refund remedies (replacement, store credit, or refund) are at our discretion.

We reserve the right to decline claims showing abuse, falsified evidence, or repeated unreasonable complaints.

11. ORDER CANCELLATION

Orders may be cancelled before dispatch by emailing care@sabaifresh.com.
Once dispatched, perishables cannot be cancelled due to their time-sensitive nature.
For prepaid orders cancelled before shipment, refunds will be processed within 7 business days to the original payment method.

12. PROMOTIONS, DISCOUNTS & VOUCHERS

Promotions and vouchers are subject to specific terms.
They are non-transferable, non-redeemable for cash, and valid only within stated periods.
We reserve the right to cancel or adjust any promotion due to misuse, system error, or fraudulent activity.

13. INTELLECTUAL PROPERTY

All logos, trademarks, text, graphics, images, product names, and software on the SabaiFresh™ website are the property of Tindahan Global Distribution Co., Ltd. or its licensors.

You may not reproduce, distribute, modify, or exploit any material from our site without written permission.

14. REVIEWS, COMMENTS & USER CONTENT

By posting reviews or comments, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in marketing, advertising, or promotional materials.

You agree not to post:

  • Defamatory, offensive, or false content;
  • Content violating another’s rights;
  • Spam, advertisements, or links to external sites.

We may remove or moderate content at any time.

15. LIMITATION OF LIABILITY

  • We are not responsible for spoilage or damage caused by improper storage, delay in pickup, or handling after delivery.

We are not liable for failure or delay in performance due to circumstances beyond our control, including but not limited to acts of nature, strikes, transport disruptions, government restrictions, or pandemics.

17. PRIVACY & DATA PROTECTION

Your data privacy is governed by our Privacy Policy, which forms an integral part of these Terms.
We comply with Hong Kong’s Personal Data (Privacy) Ordinance (PDPO) and relevant international standards.

18. INDEMNIFICATION

You agree to indemnify and hold harmless SabaiFresh™, its officers, employees, and partners from any claims, damages, or expenses (including legal fees) arising from your breach of these Terms, misuse of the website, or violation of any law.

20. GOVERNING LAW & JURISDICTION

These Terms are governed by and construed under the laws of Hong Kong SAR.

For cross-border operations, relevant local laws (Thailand/Philippines) may apply for transactions originating there, but the governing law remains Hong Kong for this website.
